IN THE MATTER OF J.D.B., 686 S.E.2d 135 (N.C. 2009).

 

Petition for writ of certiorari to the North Carolina Court of Appeals is GRANTED and limited to the following questions:

 

1. Whether a court must consider a juvenile’s age in a Miranda custody analysis in evaluating the totality of the circumstances and determining whether a reasonable person in the juvenile’s position would have felt he was not free to terminate police questioning and leave?

2. Whether the fact that a police interrogation of a minor takes place at a minor’s school, with the assistance or approval of school authorities, establishes that the minor is “in custody” for the purpose of a Miranda determination?

 

ORDERED that this case be set down for argument in the October 2010 term of this Court.
