(1) Felonies are crimes which are punishable by imprisonment
for one or more years.
(2) Misdemeanors are crimes the minimum punishment of which is
less than one year's imprisonment or a fine.
(3) Aggravating or mitigating circumstances, which are provided
for in accordance with the provisions of the General Part or for
especially serious or less serious cases, shall not be taken into
consideration in making this division.
