The previous Article will not apply to:
1. Political crimes or crimes that are of the exclusive jurisdiction of the military.
2. A foreign and rinal judgment of conviction as provided in Article 5, when the conduct in question is not a crime according to national law.
3. Previous convictions when the corresponding sentences have been served, and a period of time of not less than three nor more than ten years has elapsed.
4. A previous conviction for an intentional crime when the subsequent
conviction is based on recklessness or negligence, and vice versa.
