Article 38

Whenever a Particular requirement of status, personal relationship, or other individual circumstance incorporated in the statutory description of the cfiminal act is fulfilled by one of the perpetrators, all other principals and accessories who were aware of it will be dealt with as if they too fulfilled the requirement.

Those who were not aware of it will be punished as provided for perpetrators not fulfilling said requirement.

Status, personal relationships and other individual circumstances not incorporated in the statutory description of the criminal act, will only affect the liability of those in whom said circumstances concur.
